lowermyhealthinsurance.com.au is owned and operated by EMBR Group Pty Ltd ABN 27 147 278 153 (“EMBR”, “Lower My Health Insurance”, “we”, “us” or “our”).
These Terms govern your use of lowermyhealthinsurance.com.au (the “Website”) and any enquiry you submit through it. By using the Website or submitting an enquiry, you agree to these Terms and acknowledge our Privacy Policy.
1. Eligibility
The Website is intended for Australian residents aged 18 years or over. By submitting an enquiry, you confirm that you meet this requirement.
2. Nature of our service
Lower My Health Insurance provides a free health insurance comparison enquiry and referral service. Depending on your enquiry and the information you provide, EMBR may refer your details to a relevant third-party provider, including:
- a private health insurer or health fund;
- a health insurance broker or comparison service;
- a consultant or adviser who helps people compare health cover;
- a customer-service or call-centre provider; or
- another service provider whose services are reasonably connected with the reason you gave for your enquiry.
Submitting an enquiry is not an application for health insurance, and it does not create a policy. We do not guarantee that your enquiry will be accepted or referred.
3. What Lower My Health Insurance does not do
Unless expressly stated otherwise, EMBR does not through the Website:
- recommend a particular health fund or policy;
- decide that a particular policy is suitable for you;
- accept or decline an application for health insurance;
- arrange, issue or change a policy; or
- submit an application on your behalf.
Any policy is issued by the health fund you choose, on that fund’s terms. Where a consultant or provider compares policies for you after your enquiry, that comparison is theirs and not ours.
4. What may happen after an enquiry
EMBR may process the information you provide to check whether your enquiry meets referral criteria and to identify a provider that may be able to assist. Contact from a provider may involve:
- confirming or updating information you submitted;
- discussing your reason for comparing;
- explaining available services;
- going through cover options from the funds they compare; or
- introducing you to another relevant provider.
5. Referral criteria
Referral criteria may include your age, state, whether you are an Australian resident, your current fund, the type of cover you want and other information relevant to participating providers. Meeting our referral criteria does not mean that:
- a lower premium is available to you;
- changing fund or cover is right for you;
- an insurer will accept you or a consultant will recommend a change; or
- any particular service or outcome will result.
6. Health funds and providers
Where your enquiry is referred to a provider, that provider is responsible for the services it gives you, including any comparison, recommendation, application or policy information. The funds and policies a provider considers depend on its arrangements, its eligibility criteria and the information available about your circumstances, and may not include every fund or policy available in Australia.
References on the Website to a number of health funds, or to fund logos, do not mean that every fund shown will be considered in every person’s circumstances. Logos are the property of their owners and do not indicate that the fund endorses or is affiliated with us.
7. No guarantee of outcomes
Submitting an enquiry does not guarantee:
- acceptance by any health fund;
- access to a particular fund or policy;
- a lower premium or any saving;
- that your existing cover, waiting periods or benefits will carry over;
- eligibility for a promotion or discount; or
- any particular outcome.
Actual outcomes depend on your circumstances and on fund rules, including your age, state, level of cover, waiting periods, exclusions, limits, premiums, and your eligibility for any Australian Government rebate or loading.
8. Fund promotions and offers
The Website or a provider may refer to promotions or offers made by health funds. They are provided by the fund, and may apply only to particular policies, have eligibility criteria, conditions and deadlines, and change or be withdrawn without notice. Read the fund’s own terms before you rely on one.
9. Information on the Website
Information on the Website is general in nature. We take reasonable steps to keep it accurate and current, but fund policies, premiums, promotions and eligibility rules change. It should not be taken as confirmation that a particular fund, policy, premium or saving is available or suitable for you.
10. No personal advice
Unless expressly stated otherwise, EMBR does not give you personal advice through the Website about which health fund or policy to choose. Information on the Website does not take account of your health needs, personal circumstances or budget. Read the product information and policy documents for any policy before you decide, and note that the Commonwealth Ombudsman’s privatehealth.gov.au publishes independent information about private health insurance.
Where a provider gives you a recommendation or other service, that provider is responsible for it and for meeting the obligations that apply to it.
11. Contact about your enquiry
By submitting an enquiry, you request contact in relation to that enquiry. You consent to being contacted by EMBR, and by a provider to whom your enquiry has been referred, by:
- telephone;
- SMS; and
- email.
You confirm that the mobile number you give us is yours, and we send a one-time code to it to check.
12. Referral fees and remuneration
EMBR may receive a fixed or predetermined referral fee from a participating provider for an eligible enquiry. The referral amount is not determined by:
- your age or state;
- your current fund or level of cover;
- the fund or policy ultimately selected or recommended;
- the premium you pay; or
- whether you take out or change a policy.
Different providers may have different predetermined commercial arrangements with EMBR. You are not charged by EMBR for submitting an enquiry through the Website.
13. Third-party providers
Third-party providers operate separately from EMBR. They are responsible for their own services, representations, comparisons, recommendations, contractual terms, privacy practices, licensing and legal obligations. Nothing in these Terms excludes EMBR’s responsibility for its own advertising, referral activities, privacy obligations or conduct.
14. Marketing communications
Contact relating directly to an enquiry you submitted is separate from future marketing communications. Where you have consented, or where otherwise permitted by law, EMBR may send marketing communications about EMBR or relevant third-party products and services. You may opt out at any time using the unsubscribe mechanism provided or by contacting unsubscribe@embr.com.au.
15. Privacy
We handle personal information in accordance with our Privacy Policy, which explains how information may be collected, used and disclosed, including disclosure to providers other than health funds where relevant to your enquiry.
16. Cookies and tracking technologies
The Website may use cookies, pixels, analytics and similar technologies for Website functionality, analytics, advertising measurement, attribution, remarketing and improving Website performance.
17. Intellectual property
All Website content, including text, images, graphics, branding, design, trade marks and software, is owned by or licensed to EMBR unless otherwise stated. You may use the Website for personal, non-commercial purposes. You must not copy, reproduce, modify, distribute or commercially exploit Website content without our prior written consent, except where the law permits. Third-party trade marks remain the property of their owners.
18. Website availability and security
We take reasonable steps to keep the Website available, accurate and secure. We do not guarantee that it will always be uninterrupted, error-free, free from harmful software or compatible with every device or browser. We may suspend or restrict access for maintenance, security, technical or operational reasons. You are responsible for the security of your own devices. Nothing in this section limits obligations that cannot lawfully be excluded.
19. Limitation of liability
To the extent permitted by law, EMBR is not responsible for loss arising solely from:
- reliance on Website information that has become outdated;
- the unavailability of a particular provider, fund, policy or service;
- a provider deciding it cannot assist;
- decisions made independently by a third-party provider;
- information you supplied inaccurately; or
- technical interruptions outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies rights, guarantees or remedies that cannot lawfully be excluded.
20. Acceptable use
You must not use the Website:
- unlawfully or fraudulently;
- to deliberately submit false or misleading information, including a mobile number that is not yours;
- to interfere with Website security or functionality;
- to attempt unauthorised access to systems or data; or
- in a way that could damage or disrupt the Website.
21. Changes to these Terms
We may update these Terms from time to time to reflect changes to our services, business practices, technology or legal obligations. The current version is published on the Website with its updated date.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, it is severed to the extent necessary and the remaining provisions continue to apply.
23. Governing law
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from those courts.
