lowermyhealthinsurance.com.au is owned and operated by EMBR Group Pty Ltd ABN 27 147 278 153 (“EMBR”, “Lower My Health Insurance”, “we”, “us” or “our”).

We respect your privacy and handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and other applicable Australian laws.

This Privacy Policy explains how we collect, hold, use and disclose personal information when you visit lowermyhealthinsurance.com.au (the “Website”), submit an enquiry or otherwise interact with us.

1. Who we are

Lower My Health Insurance provides an online health insurance comparison enquiry and referral service.

When you submit an enquiry, we collect information about your current health cover and what you are looking for so that we can process your enquiry and refer it to a relevant third-party provider. Depending on your enquiry, this may include:

  • a private health insurer or health fund;
  • a health insurance broker or comparison service;
  • a consultant or adviser who helps people compare health cover;
  • a customer-service or call-centre provider; or
  • another service provider whose services are reasonably connected with the reason you gave for your enquiry.

Any policy you take out is issued by the health fund you choose, not by us.

2. Personal information we collect

The information we collect depends on how you interact with us and the nature of your enquiry. It may include:

  • your name, mobile number and email address;
  • your state or location;
  • your age or age range;
  • whether you are an Australian resident;
  • your current health fund;
  • the type of cover you have or want (for example hospital, extras or both);
  • what you currently pay for your health insurance;
  • your reason for comparing;
  • information you provide through online forms, telephone calls, SMS or email;
  • records of your enquiry, your consent and any referral;
  • your IP address, device type, browser information, website activity, cookies and advertising identifiers; and
  • any other information you voluntarily provide to us.

Our form does not ask about your medical conditions or health history. Information about your health is sensitive information under the Privacy Act. If you choose to tell us, or a provider we refer you to, about your health, we will only collect and use it with your consent or as otherwise permitted by law.

We seek to collect only information reasonably necessary for our functions and activities.

3. How we collect your information

We may collect personal information:

  • directly from you when you complete a form, submit an enquiry or communicate with us;
  • through our websites and landing pages;
  • through advertising lead forms;
  • through telephone, SMS or email communications;

4. Why we collect and use your information

  • prevent fraud, misuse and security incidents;
  • manage complaints and enquiries;
  • comply with legal and regulatory obligations; and
  • use or disclose information for other purposes permitted or required by law.

5. Referral criteria and automated processing

We may use automated systems to help validate and manage enquiries, including to check whether an enquiry meets the minimum criteria for referral to participating providers. These criteria may include:

  • your age;
  • your state;
  • whether you are an Australian resident;
  • your current fund; and
  • the type of cover you are looking for.

If an enquiry does not meet the applicable criteria, it may not be referred through our service.

Our systems do not approve or decline health insurance applications, decide whether an insurer will accept you, select a policy for you, or decide whether a policy is suitable for you. A provider to whom your enquiry is referred will carry out its own assessment and may ask you for additional or updated information.

We do not currently use individual lead scoring to determine which participating provider receives an enquiry based on the value or characteristics of that individual lead.

We may update the technology we use from time to time. Where a new use of personal information needs additional notice, consent or changes to this Privacy Policy under applicable privacy laws, we will take the required steps before or when that use starts.

6. Who we may disclose your information to

Depending on your enquiry, we may disclose personal information to:

  • private health insurers and health funds;
  • health insurance brokers, comparison services, consultants and advisers;
  • customer-service and call-centre providers;
  • other service providers whose services are reasonably relevant to your enquiry;
  • CRM, telephone, SMS and email service providers;
  • website hosting and cloud-storage providers;
  • analytics and advertising platforms;
  • data-verification and fraud-prevention providers;
  • professional advisers and contractors;
  • regulators, courts, government agencies or law-enforcement bodies where required or authorised by law; and
  • other parties where you have specifically consented to the disclosure.

We do not represent that every provider to whom an enquiry is referred is a health fund or a licensed insurer.

7. What may happen after a referral

After a referral, the provider may:

  • confirm or update the information you submitted;
  • discuss your reason for comparing;
  • explain the services their business provides;
  • go through cover options from the funds they compare; or
  • introduce you to another relevant provider.

A consultant’s comparison may not include every health fund or policy available in Australia.

8. How EMBR is paid

EMBR may receive a fixed or predetermined referral fee when an eligible enquiry is referred to a participating provider. The amount payable to EMBR is not determined by:

  • your age or state;
  • your current fund or level of cover;
  • the fund or policy ultimately considered or recommended;
  • the premium you pay; or
  • whether you ultimately take out or change a policy.

Different participating providers may have different commercial arrangements with EMBR. You are not charged by EMBR for submitting an enquiry.

A provider may separately receive commissions, fees or other remuneration in connection with services it provides to you. Any required disclosure of those arrangements is the responsibility of that provider.

9. Contact about your enquiry

When you submit an enquiry, you are requesting contact in relation to that enquiry. You may be contacted by EMBR, and by a provider to whom your enquiry has been referred, by:

  • telephone;
  • SMS; or
  • email.

Submitting an enquiry does not guarantee that a provider will be able to assist, or that any particular policy, premium, saving or service will be available.

10. Marketing communications

We may send marketing communications where you have consented to receive them or where otherwise permitted by law. They may relate to products or services offered by EMBR or relevant third parties.

You may opt out at any time by:

  • using the unsubscribe link in an email;
  • replying STOP to an SMS where that facility is available; or
  • emailing unsubscribe@embr.com.au.

Withdrawing marketing consent does not necessarily prevent contact reasonably necessary to deal with an enquiry or service you have already requested.

11. Cookies, analytics and advertising

We may use cookies, pixels and similar technologies to:

  • operate the Website;
  • remember your form progress;
  • understand Website usage;
  • measure advertising performance and attribute enquiries to campaigns;
  • improve our services;
  • detect fraud; and
  • support advertising and remarketing.

These technologies may collect your IP address, browser, device type, Website interactions and advertising identifiers. You can control or disable cookies using your browser settings, although some Website functionality may be affected.

12. Overseas disclosure

We take reasonable steps to protect personal information we hold from misuse, interference, loss, unauthorised access, modification and disclosure. Our safeguards include technical, administrative and organisational measures appropriate to the nature of the information.

15. Retention

We keep personal information for as long as reasonably necessary to process enquiries and referrals, meet legal and regulatory obligations, keep consent records, handle complaints and disputes, prevent fraud and meet other legitimate business needs. When information is no longer required and we are not required to keep it, we take reasonable steps to destroy or de-identify it.

Where required by law, we assess suspected eligible data breaches and notify affected individuals and the Office of the Australian Information Commissioner under the Notifiable Data Breaches scheme.

17. Access and correction

18. Deletion and de-identification

You may ask us to delete or de-identify personal information we hold about you. Australian privacy law does not give an unrestricted right to deletion in every circumstance, and we may need to keep information for legal, regulatory, record-keeping, dispute-resolution or other legitimate purposes.

19. Third-party privacy practices

Where your enquiry is referred to another provider, that provider has its own privacy policy and is responsible for the personal information it later collects and handles. We encourage you to read it when you deal with them.

20. Complaints

We will investigate and respond within a reasonable period. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner.

By submitting your information into lowermyhealthinsurance.com.au you explicitly consent to our supplying your information to third parties and to receiving a call, SMS or email about your enquiry. Please refer to our Privacy Policy for further information about how we handle your information. We do not provide financial product advice or dealing services, nor does EMBR promote financial products or product issuers. We endeavour to pass your enquiry on to a third party that can offer you a comparison of a wide range of products, providers and services. However, we do not compare every provider in the market, and you should, before engaging any provider, consider whether the product is appropriate for you in the context of your personal and financial circumstances and needs. You should consider the provider's disclosure documents, such as the product disclosure statement, before you take out a policy. If you decide to proceed with a policy after a referral from lowermyhealthinsurance.com.au, you will be dealing directly with that provider and not with EMBR.
